ACCEPTANCE OF TERMS & CONDITIONS Top
A1) Online Orders
By processing any order through PatioShoppers’ online retail store, the customer (which shall also herein be known as the purchaser) acknowledges acceptance of the terms and conditions contained herein. A copy of the order transaction, including all terms and conditions, will automatically be sent, via e-mail, to the purchaser’s email address, given at the time of order. It is the customer's responsibility to fully read and understand these terms and conditions contained herein.
A2) Phone Orders
By placing an order via telephone, verbally through the PatioShoppers Customer Service department, or electronically through e-mail or facsimile, the customer is acknowledging acceptance of all terms and conditions of the PatioShoppers online retail store via this website A copy of the order transaction, including all terms and conditions, will automatically be sent, via e-mail, to the purchaser’s email address, given at the time of order. It is the customer's responsibility to fully read and understand the terms and conditions contained herein.
A3) Cancellation and Change Policy
We, at PatioShoppers.com, have fully researched the fastest way to get your product into your hands so that you can enjoy it sooner! Our orders are automatically placed with the manufacturers for a virtually seamless process. Any and all changes to the order MUST be requested within 24 hours to ensure that we can make the change, unless it is a “Quick Ship” item that was processed and shipped the same day. Should you still want to request a change to an order that has already shipped, it may be done using our PREFERENCE RETURNS guidelines. If your order is refused upon delivery, the fees will be deducted from the refund. We will work with you, so please keep us updated and apprised of any actions.
Cancellation requests must be submitted in writing via e-mail, and/or standard post - this is for your protection. All cancellation confirmations will be sent via the same form of communication as the customer-initiated cancellation request. If you do not receive a cancellation confirmation, please contact our Customer Service department immediately. The customer/purchaser is responsible for all incurred costs including shipping in both directions if this procedure has not been confirmed and completed in written format. Should an item be refused delivery without proper authorization, customer shall be responsible for incurred costs as well.
Custom or Special Orders
Note: If a custom or special order including special order fabric has been processed to a manufacturer or it is within 24 hours of order being placed AND/OR the work has been performed, the custom/special order is considered non-cancelable.
RETURN AND WARRANTY POLICIES - General Top
Please refer to individual product order pages for specific conditions pertaining to manufacturing lead times, additional shipping parameters and/or other additional options regarding your order.
RG1) General Policy
On top of the FREE SHIPPING to you, should you find that it simply is not going to work, give us a call and we will send you RA # and return label. Once we receive the product back in 100% sellable condition we calculate your refund less the discounted UPS charges of the return label. Those discounted rates are earned by us as a company and we are happy to share them with you. It's that easy and Hassle Free! Canadian Customers, please note: Charges for handling, taxes and duties cannot be returned.
In cases of verifiable manufacturing defect, PatioShoppers will arrange for merchandise return if notified within 14 days of receipt of product. PatioShoppers reserves the right to repair or replace such merchandise at PatioShoppers’ discretion any time after delivery of the product. If it is determined upon inspection that there is no defect and the product is not in 100% sellable condition, the refund amount will be prorated to reflect the current sellable state of the product. Refunds are typically issued within 7 business days of our inspection of returned items. Should any item be refused delivery and returned without authorization, the customer may incur any manufacturer restocking fees of up to 25% plus all shipping and handling fees. Please remember we are here to help, so contact us rather than refuse delivery. Only items with proper Return Authorization numbers (RA#) are eligible for a full purchase price refund.
Some items are too large for standard UPS or FedEx Ground and may be required to be shipped via motor freight. Items deemed too large for common carrier may be subject to additional lead times and will be charged return shipping. Items must be inspected for damage at time of delivery and noted on the delivery receipt prior to signing for shipment. Notification of damages must be submitted in writing within 7 business days of product delivery. All items must be inspected for damage before assembly. Should damage or defects occur, customer must contact PatioShoppers in writing prior to assembly. Products that have been assembled or modified cannot be returned for any reason per manufacturers’ guidelines. Please see the FREIGHT SHIPPING section below for more details.
When returning an item for any reason, the item MUST be packaged in the original carton. Items that have been scratched or dented by set up, placement in stands, bases or tables, movement of furniture, etc., are considered unsellable and/or no longer in new condition. Unsellable items will not be accepted for return, unless there has been a clear manufacturing defect or warranty issue.
While we offer free shipping on our entire online selection of products, there are times when we help customers find replacement parts, additional add-ons and specialized items. At that time we may have to charge a shipping fee in order to get that product shipped straight to your door! There will never be any hidden charges; we will quote the entire order prior to taking your payment!
RG2) Return Authorization
All items must have a valid Return Authorization number (RA#) prior to being returned to PatioShoppers. The customer/purchaser must contact PatioShoppers in writing via e-mail or standard post in order to obtain an RA# prior to returning any product. Should any questions arise, it is the customer's responsibility to contact PatioShoppers for further clarifications. PatioShoppers is not liable to credit funds of any type or contact any customer regarding items that have been returned without prior written authorization and an approved Return Authorization number. Please see DAMAGED GOODS and PREFERENCE RETURNS sections below for more details.
RG3) Damaged Goods
All of our products are warranted to be free of manufacturing defects. If, for some reason, a challenge or defect has occurred with a product, the customer must contact us via e-mail or standard post within 14 days of product delivery - unless specified in RETURN AND WARRANTY POLICIES – Specific section below. We reserve the right to repair, replace or refund such merchandise at PatioShoppers’ discretion. Our refund policy does not cover items damaged due to misuse, neglect, wind, weather conditions or other "Acts of God". It is the customer's responsibility to properly care for, maintain, store and safely use the products ordered. If any questions arise regarding proper use, please e-mail questions to customerservice@PatioShoppers.com. If during the inspection upon return the product is found not to be damaged all shipping fees will be deducted from the refund amount to the customer.
RG4) Preference Returns
All preference returns are subject to a 25% restocking fee and return shipping charges. Requests to return items for any “preference reason” must be made in writing within 14 days of item delivery. The customer/purchaser must contact PatioShoppers in writing within 14 days of item delivery via e-mail or standard post in order to obtain an RA# prior to returning any product. All return items must have a valid Return Authorization number (RA#) prior to being returned to PatioShoppers. Should any questions arise, it is the customer's responsibility to contact PatioShoppers for further clarifications. PatioShoppers is not liable to credit funds of any type or contact any customer regarding items that have been returned without prior written authorization and an approved Return Authorization number.
RETURN AND WARRANTY POLICIES - Specific Top
RS1) Umbrellas & Stands
All items must be physically inspected directly out of the box without being placed in a stand/or table. Should any damage including but not limited to scratches, dents, rips and/or fabric tears occur from placement in stands or tables, items are no longer considered as new and will not be accepted for refund or replacement. Actual umbrella fabrics and components may vary slightly from color charts and/or pictures displayed due to particular lighting effects, computer monitor displays, graphics and availability of particular seasonal items. Therefore, PatioShoppers cannot be held accountable for any persons who improperly decide a specific color choice or unit style based on the visual picture only. Customers may contact PatioShoppers prior to order and request the procedure for obtaining fabric samples.
RS1a) ShadeScapes USA Disclaimer
PLEASE THOROUGHLY READ OWNER’S MANUAL, INSTRUCTIONS AND WARRANTY BEFORE INSTALLATION, ASSEMBLY AND OPERATION. Please be advised that manufacturer warranties do not cover damage caused by incorrect installation, wind, improper canopy folding, or wrongful use of the product. Read all manuals and instructions carefully to ensure proper installation, assembly and operation. Once installed, ensure all users are properly trained in operation and wind guidelines. On the subject of wind resistance, always use COMMON SENSE: If it is too windy to be outside enjoying the day, it is always best to lower/collapse the fabric canopy structure. It is also best to keep the fabric canopy structure lowered/collapsed when unattended. See the Owner’s Manual (Shademakers) and Instructions/ Warranty (Paraflex, Rimbou, Ingenua) to find installation, assembly, and operation instructions in addition to detailed wind guidelines for the specific shade solution purchased. TRANSIT DAMAGE - Claims made for damage to goods while in transit should be initiated with ShadeScapes USA within 5 days of receipt of product. Photographs of the damaged packaging and/or concealed damages will provide aid in the claims process. A full inspection of goods upon delivery will dramatically aid in the claims process. In the event that notice of damage is not given within 5 days, the claim may be denied.
All cushions are considered custom/special ordered and manufactured to customer's specific dimensions and color specifications. Cushions are non-returnable or refundable unless a clear manufacturing defect has occurred. Cushions may vary slightly in thickness and size dimensions, within 1/4 to 1" due to internal filling compaction, rebound, and styles of edging, stitching and particular internal fill. Cushions are non-returnable if size and filling dimension are within the parameters as previously described. All items should be physically inspected directly out of the box and/or packaging without being placed in the appropriate piece of furniture. Should any damage including, rips, tears, stains, marks or color transfer, etc., occur from placement in stands or tables, furniture, etc., said items are no longer considered as new and will not be accepted for refund or replacement. Actual cushion fabrics and components may vary slightly from color charts and/or pictures as displayed due to particular lighting effects, computer monitor displays, graphics and availability of particular seasonal items, therefore PatioShoppers cannot be held accountable for any persons who improperly decide a specific color choice or unit style dependent on the visual picture only. No returns will be accepted for improper color choices dependent on the color computer monitor displays. Customers may contact PatioShoppers to request assistance with color selection prior to ordering product.
RS3) Patio Furniture
While most items are shipped partially unassembled in cartons (Basic Assembly Required), some items are shipped via motor freight and are too large for standard UPS or FedEx Ground. Items deemed too large for common carrier may be subject to additional lead times. Items must be inspected for damage at time of delivery and noted on the delivery receipt prior to signing for shipment. Notification of damages must be submitted in writing within 14 days of product delivery. All items must be inspected for damage before assembly. Should damage or defects occur, customer must contact PatioShoppers in writing prior to assembly. Products that have been assembled or modified cannot be returned for any reason per manufacturers’ guidelines.
RS4) Tiki or Thatch Umbrellas & Palapas
These umbrellas are attractive and decorative but they are not recommended for use in or close to chlorinated water. The chlorine can degrade the stitching in the canopy causing it to shed. Please be sure to use only fabric canopies in or close proximity to chlorinated water. If this is the design choice for your living space PatioShoppers.com will not be held accountable for damaged thatch canopies. We are always available to answer any questions or make other suggestion for your selection of outdoor umbrella.
RS5) Patio Heaters, Fire Pits & Outdoor Fireplaces
Most Heaters, Fire Pits and Outdoor Fireplaces are shipped partially unassembled and typically need some basic assembly. Patio heaters must be inspected within 3 business days of product delivery, unless delivered via freight services in which case immediate inspection is mandatory before the driver departs your location. Should there be a manufacturing defect or challenge, buyer must contact PatioShoppers, Inc., in writing within 14 days of product delivery for instructions on how to return or remedy the issue or the sale will be considered final. PatioShoppers maintains the right to substitute parts or new units as a remedy of the situation. Patio Heaters are “non-returnable” once they have been assembled, installed, fired and/or have been in use for “any” length of time, unless there is a clear manufacturing defect. PatioShoppers is a reseller of said products only and is in no way considered mechanical engineers or responsible for particular heat loads or calculations. All authorized preference return items must be in “brand new” un-used, sellable condition. If any parts or components have been damaged in any way, it is the customer’s responsibility to pay for additional damage. PatioShoppers is not responsible for electrical wiring, gas piping and/or fuel containment as needed for specific units, and cannot be held liable for installation challenges or upgrades of any kind, before or after installation. If a customer chooses to acquire his or her own contractor for product installation, PatioShoppers, Inc. cannot be held liable for the installation costs regardless of whether a specific unit was recommended by a representative of PatioShoppers or not. It is highly recommended that a contractor and/or mechanical engineer be consulted prior to any purchase or installation of permanent or mounted units. Heater specifications have been included as a guideline and are only intended as a general idea of heating ranges or capacities. All outdoor heating situations differ and buyer is responsible to acquire their own heat load calculations, permits or engineering as needed for proper heating in their specified locations.
PatioShoppers’ Customer Service representatives and employees are in no way considered manufacturer representatives or professional HVAC consultants, and can only give the best recommendations for heating specified areas obtained from the specific manufacturer’s literature or manufacture-provided training. PatioShoppers, Inc, its employees and manufacturers, cannot be held accountable for a customer’s specific unit choice, style or size. Specific heating parameters for outdoor situations are not a controlled environment and in no way can be guaranteed due to weather, wind & natural effects caused by nature or “acts of god”. PatioShoppers is not, and cannot be held liable for improper heating of a specific unit of any kind. PatioShoppers, Inc. cannot be held liable for any claims for damages of personal property, or bodily harm, or death as a result of any burn, explosion, fire of any type, and/or issues deemed as a result of misuse, handling, manufacture defects, accidents and/or any other reason.
RS6) Holiday Items
In the absence of a manufacturers defect, preference returns on holiday trees, wreaths and garlands after Dec 24th, will be issued in the form of PatioShoppers.com store credit.

GS1) Tracking Numbers
PatioShoppers’ computer system will automatically send available tracking numbers through email notification as received from particular distributors as soon as possible. However, not all of PatioShoppers’ distributors have resources to process shipment tracking numbers though an electronic computer system. UPS, Fed Ex or Freight carrier tracking numbers are not always readily available and are not typically supplied to the customer until after 2 to 5 business days from initial shipment verification. We recommend signing up for UPS My Choice as UPS is our primary shipper and UPS My Choice is an excellent way to get current updates on packages to your address. If any shipping disputes or challenges with the order occur, customer should email or contact PatioShoppers with the appropriate name, address, phone number, item number, description of purchase and/order number for faster response.
GS2) Tracking Number Requests
Due to extremely high volume of orders processed in the spring and summer seasons, PatioShoppers’ goal must be focused on processing orders as fast as possible to expedite a speedy shipment. PatioShoppers simply does not have the resources and/or time to respond or reply to all tracking number requests UNTIL after the minimum manufacturing & processing days have been allotted and/or a clear order processing challenge has occurred. We recommend signing up for UPS My Choice as UPS is our primary shipper and UPS My Choice is an excellent way to get current updates on packages to your address. Customers should check the product description page of the item they ordered regarding estimated lead times. If the item is noticeably late and/or missing, subsequent to the last business day of the estimated manufacturing lead time and shipping estimate, customer should contact PatioShoppers via email at info@PatioShoppers.com and include the Name, Order Id and estimated delivery time located on the product description page.

S1) Shipping Lead Times - Shipping lead times details are provided in a link in all products. Once items ship from warehouse, shipping time may take anywhere from 1 to 14 business days depending on products ordered and particular freight carrier arrangements. Once an item has been manufactured, assembled, packaged and shipped, standard shipping lead time listed above will apply.

PatioShoppers.com utilizes a variety of different carriers based on package size, weight, and destination. The shipping charges incurred on your order do not include custom fees or import duties, which may be incurred when your package reaches your country. PatioShoppers.com has no control over these charges and cannot estimate the amount. We recommend you contact your customs office for specific information. Should a customer request to return an international order, all shipping charges are the sole responsibility of the customer. Also, charges for handling, taxes and duties cannot be returned.
All customs and/or duty charges are the sole responsibility of the recipient.
It is the customer’s responsibility to handle any additional customs paperwork that would be necessary in the delivery of merchandise. When receiving goods from PatioShoppers.com, you are considered the importer and must comply with all laws and regulations applicable with your country. All shipments are subject to opening and inspection by customs authorities.
For products shipped internationally, please note that some manufacturer’s warranty may not be valid; manufacturer service options may not be available; product manuals, instructions and safety warnings may not be in the destination country’s languages; the products (and accompanying materials) may not be designed in accordance with destination country’s standards, specifications, and labeling requirements; and the products may not conform to destination country’s voltage and other electrical standards (requiring use of an adapter or converter if appropriate). When ordering from PatioShoppers.com, the recipient is the importer of record and must comply with all laws and regulations of the destination country. You are responsible for assuring that the product can be lawfully imported to the destination country.
Your privacy is important to us, and we know that you care how information about your order is used and shared. We would like our international customers and customers shipping products internationally to be aware that cross-border shipments are subject to opening and inspection by customs authorities.
Also, we may provide certain order, shipment, and product information, such as titles, to our international carriers, and such information may be communicated by the carriers to customs authorities in order to facilitate customs clearance and comply with local laws.
If the order is a gift, the package is marked "Gift," but the cost of the item is still stated on the customs form. Customs authorities require the value of the gift item to be stated directly on the package.
IS5) Customs, Duties, and Taxes
Orders that are shipped to countries outside of the U.S. may be subject to import taxes, customs duties and fees levied by the destination country ("Import Fees"). The recipient of an international shipment may be subject to such Import Fees, which are levied once a shipment reaches your country. All and any custom fees are the responsibility of the recipient upon receipt of your merchandise. Please note, when returning a product, charges for handling, taxes and duties cannot be returned. Taxes and duties are levied by the destination country and not PatioShoppers.com.
Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary; you should contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates. . IS6) Payment of Custom Fees
All and any custom fees are the responsibility of the recipient and due upon receipt of your merchandise. The Shipping carrier will notify you by phone prior, to receiving your order, to make arrangements to collect any and all Custom fees incurred. Fees are payable by check, money order or credit card. Arrangement for payment of customs fees are made with the shipping carrier. PatioShoppers.com has no control or involvement in custom fees. Please note, when returning a product, charges for handling, taxes and duties cannot be returned.
FREIGHT SHIPPING Top
If the product(s) you ordered arrives via freight carrier, the freight company will arrange to deliver the item(s) when you are present. The freight carrier generally will not bring your merchandise past "curbside." Regardless of the condition of any shipping carton(s), customer is responsible to thoroughly inspect the condition of all items delivered upon receipt while the delivery driver is present. Any damages must be noted on the delivery receipt and PatioShoppers.com must be notified immediately to allow for claim filing with the shipping carrier. If this procedure is not followed the customer will be responsible for filing any claims for damage with the freight company. Please note that customer will be charged return shipping.
FS1) Standard Truck Delivery
If the product(s) ordered arrives via freight carrier, the freight company will arrange to deliver the item(s) when you are present. With Standard Freight Delivery you will be required to move the package off of the truck yourself. You may need to arrange to have someone there to assist you. As with any product delivery it is important to examine your products immediately for any shipping damage and order accuracy. If an item arrives damaged or in error, the original packaging will need to be retained in order to resolve the challenge.
FS2) Liftgate Delivery
For an additional $65.00 the freight carrier can be contracted to perform "Liftgate Services". With Liftgate Service the carrier will bring the item(s) off the truck to curbside. You may need to arrange to have someone there to assist you in moving the package from the curb to your location of choice on your property. As with any product delivery it is important to examine your products immediately for any shipping damage and order accuracy. If an item arrives damaged or in error, the original packaging will need to be retained in order to resolve the challenge.
PatioShoppers will never sell; trade and/or distribute customer's personal information, such as email addresses, residential or business addresses, phone numbers, credit card information, etc., to any parties outside of this transaction authorization.

M1) Product Descriptions
PatioShoppers.com and its affiliates attempt to be as accurate as possible. However, we do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall issue a credit to your credit card account in the amount of the charge. We apologize for any inconvenience this may cause you. If you are not completely satisfied with your purchase you may return it as described in our Return policy.
M2) Payments & Credits
All orders are automatically billed to customer's credit card through our secure merchant billing system prior to shipment. Custom orders must be paid for in advance prior to any custom work to be performed. Should a challenge occur, customer must submit a credit request in writing stating the challenge to be resolved and why a credit should be awarded. Credit requests must be emailed to info@PatioShoppers.com and must include, Name, Order ID and a statement of facts. Once a credit amount is verified to be accurate and payable, the actual amount will be credited to the original credit card. If there is a challenge with the credit card, a check will be mailed directly to the intended recipient.
M3) PatioShoppers Cash
Selected products on the site qualify for PatioShoppers Cash. The cash reward is redeemable on a future product only. The more purchases you make on qualifying products, the more PatioShoppers Cash you have.
Each product that qualifies is identified by the icon on the shopping page, and is subject to change at any time. PatioShoppers cash can be redeemed by calling 1-800-940-3123. At that time your PatioShoppers Cash will be deducted from your sale price for any item over $100 (one hundred dollars).
PatioShoppers Cash can only be combined if all orders that earned PatioShoppers Cash were charged to the same billing name and address. PatioShoppers Cash cannot be redeemed for currency of any type and must be used for a store purchase within 1 year of the initial qualifying purchase. Should you make a preference return on a product where you applied your PatioShoppers Cash, that amount will be deducted from any refund amount, but can be banked as store credit toward a future store purchase.
